By accessing or using WarmySender ("Service," "we," "us," or "our") at warmysender.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
WarmySender is a B2B cold email outreach platform that provides:
You must create an account using our sign-in flow to use the Service. You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate, current, and complete information during registration and keep it updated.
You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
Each user may maintain only one account. Creating multiple accounts to circumvent sending limits or other restrictions is prohibited.
WarmySender offers recurring subscription plans billed through Stripe. You choose your billing term at checkout — Monthly, Annual or 3 Years — and your subscription auto-renews at the end of each billing period unless canceled.
WarmySender does not sell lifetime plans directly. Lifetime access is offered only through AppSumo, and those purchases are also governed by AppSumo's own terms. If you already hold a lifetime plan, your access continues: monthly quotas renew on the 1st of each month and there are no recurring charges. Tier changes on an AppSumo lifetime plan are made on AppSumo, and your account updates to match automatically.
All payments are processed securely through Stripe. By purchasing a plan, you agree to Stripe's terms of service. We do not store your payment card information.
You are responsible for any applicable taxes based on your jurisdiction. Prices are in USD and do not include taxes unless stated otherwise.

You may cancel your subscription at any time from your Billing page. Upon cancellation, your subscription remains active until the end of your current billing period. You retain full access to all features until that date. You may reactivate your subscription at any time before the billing period ends.
We refund a payment in full if you request it within 7 days of that payment and the account has not been used to send — meaning no campaign email, no warmup email, no LinkedIn or Instagram action, and no lead or verification credits spent since that payment. This applies to monthly, annual, and 3-year terms. Lead credits and email verification credits are not refundable to your payment method (unused credits never expire, and credits are returned to your balance for work we could not complete); LinkedIn and Instagram seats are refundable within the same window only if no account was ever connected to the seat. Outside the window, no partial refunds are issued for unused time. Where local consumer law grants you a longer cancellation right, that law applies. Lifetime plans are bought through AppSumo, so refunds are handled by AppSumo under AppSumo's refund policy rather than by us. Once AppSumo processes a refund, your lifetime access ends. If you already hold a lifetime plan and change tier from inside WarmySender, that payment follows the 7-day unused-account rule in section 5.2.
Your subscription begins on payment. Where a plan includes a free trial, you are not charged during the trial and your paid subscription begins when the trial ends.
We reserve the right to deny refunds for accounts that violate our Acceptable Use Policy or show evidence of fraudulent activity.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund, and we may report illegal activity to law enforcement.
By connecting email accounts to WarmySender, you grant us permission to send and receive emails on your behalf for warmup and campaign purposes.
You represent that you own or have explicit permission to use all email accounts connected to WarmySender.
You are responsible for complying with your email provider's terms of service (Gmail, Outlook, etc.). WarmySender is not responsible if your email provider suspends or terminates your account.
We encrypt IMAP/SMTP credentials using AES-256-GCM. OAuth tokens are stored securely and automatically refreshed. You may disconnect accounts at any time.
Your monthly email quota is determined by your license tier. Attempting to exceed your quota will result in email sending being paused until your quota resets.
To protect deliverability, we enforce mailbox-level and domain-level sending limits based on warmup mode, domain age, and performance metrics. These limits are designed to prevent spam classification.
Your email quota resets once a month. On a monthly subscription it resets on your billing date. On any longer term, and on lifetime plans, it resets on the 1st of each month. The Free tier does not have monthly resets (500 emails lifetime total). Your monthly lead allowance resets on your billing date each month, on every term, and your monthly email verification allowance resets on the 1st of each month. Lead credits and verification credits bought separately never expire and are not affected by any reset.
You retain all rights to your prospect lists, email templates, campaign content, and other data you upload to WarmySender.
We use your data only to provide the Service as described in our Privacy Policy. We do not sell your data to third parties.
You may export your data at any time through the Service. Upon account deletion, we will delete your data within 30 days, except where required by law.
WarmySender and its original content, features, and functionality are owned by WarmySender and are protected by international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license terminates if you violate these Terms.
WarmySender's name, logo, and related marks are trademarks. You may not use these without our prior written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARMYSENDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless WarmySender, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
You may delete your account at any time from your account settings. Upon deletion, your access will be terminated immediately, and your data will be deleted within 30 days.
We may suspend or terminate your account immediately, without notice, if you:
Upon termination, your license to use the Service immediately ends. Termination for violation of these Terms does not entitle you to a refund.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.
We may update these Terms periodically. We will notify you of material changes by email or prominent notice on the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance of the updated Terms.
These Terms are governed by applicable laws, without regard to conflict of law principles.
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial.
You agree to resolve disputes on an individual basis only and waive your right to participate in class actions or class arbitrations.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WarmySender.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, pandemics, or infrastructure failures.
These terms govern participation in the WarmySender affiliate program. By generating a referral link or requesting a payout, you agree to the terms in this section in addition to the rest of these Terms of Service.
As an affiliate, you earn a commission equal to 50% of the plan payments made by each customer you refer during their first 12 months as a paying WarmySender subscriber, calculated net of payment processor fees. Commission applies to subscription (plan) payments only; add-on charges, including the LinkedIn add-on, are not commissionable. Commission applies only to successful, non-refunded payments and is calculated on the plan amount actually charged, less the payment processor fees on that payment. Commissions stop accruing once a referred customer has been a paying subscriber for 12 months.
Referrals are attributed through your unique referral link. A customer is credited to you when they sign up after using your link, provided they sign up within 60 days of first clicking your link. The 60-day window is measured from the first click. If a customer signs up more than 60 days after clicking, or signs up without using your link, that signup cannot be attributed to you. We use the attribution recorded at the time of signup, and a signup that is not attributed to you at that time cannot be retroactively credited.
Each commission is subject to a 45-day holding period before it becomes available to withdraw. This holding period protects against refunds and chargebacks. A commission becomes part of your available balance only after 45 days have passed since it was earned and the underlying payment has not been refunded or reversed.
The minimum payout is $100. Once your available balance (commissions that have cleared the holding period) reaches the minimum, you may request a payout from your dashboard. Payouts are sent manually via Wise or bank transfer, and you choose your preferred method in your dashboard. Any transfer or payment-processor fees incurred in sending your payout are deducted from the amount sent. You must provide accurate payout details for the method you select (for example, the email tied to your Wise account, or your bank account details). You are responsible for keeping those details accurate and complete, and for any taxes applicable to your earnings in your jurisdiction. We are not responsible for payments delayed or misdirected due to inaccurate or incomplete payout details.
The following are not permitted and may result in forfeiture of commissions and removal from the program:
WarmySender may withhold or reverse commissions associated with fraud, refunds, chargebacks, or any violation of these terms. If a referred customer's payment is refunded or charged back, the related commission is reversed. We may also withhold payouts pending review where we reasonably suspect fraudulent or abusive activity.
We may modify or discontinue the affiliate program, including commission rates, the commission period, holding periods, and minimum payout thresholds, with notice. Changes apply on a going-forward basis; commissions already earned under prior terms are honored under the terms in effect when they were earned.
